The Ministry of Labor of the Russian Federation presented amendments to the Labor Code for public discussion to clarify the payment of compensation for work on weekends, holidays, and non-working days.
The amendments will allow employers to compensate them for work on weekends and holidays when dismissing employees if this has not been done previously.
The employee can choose the most suitable compensation option: rest days or a cash supplement.
According to current standards, work on holidays and weekends is paid to all employees at least twice the amount for the hours worked. At the employee's request, he may be given a rest day instead of increased pay.
As indicated in the explanatory note, in some cases, employers, having paid for work on holidays and weekends in the amount of salary or tariff rate, did not decide to provide a rest day and did not compensate for it upon dismissal.
The amendments were developed considering the position of the Constitutional Court. They will eliminate situations where an employee can be dismissed without compensation for work on weekends, holidays, and non-working days.
