According to the document, in order to transplant human organs and tissues, including bone marrow and hematopoietic stem cells, the written consent of an adult capable donor and recipient is required. If the recipient is a minor or incapacitated, consent must be written by a parent or legal representative.
According to the ASI, restrictions are being introduced regarding the presumption of consent to the removal of organs or tissues for transplantation. Withdrawal from a corpse is not allowed if the medical organization is aware that during the life of a person or his representative declared their disagreement with the removal. In case of death of minors - if the consent of one of the parents for such a withdrawal is not obtained.
The document clarifies that human organs or tissues cannot be the subject of sale and purchase.
A person who wants to become a bone marrow or hematopoietic stem cell donor is entitled to a free medical examination to be included in the donor registry. Donors are entitled to free transportation to and from the organ harvesting site.
The law also provides for the creation of a federal registry of bone marrow and hematopoietic stem cell donors, donor organs themselves and their recipients.
