State Duma adopted amendments to Labor Code on distance work

The State Duma adopted amendments to the Labor Code on remote work. The deputies approved the law simplifying the procedure for transferring employees to distance work in the third, final reading, the press service of the lower house of parliament reported. The law will enter into force on January 1, 2021.
Earlier, the deputy of the State Duma of the Russian Federation from Bashkortostan Zugura Rakhmatullina told the Bashinform News Agency about the most significant innovations in labor legislation.
According to the law, an employment contract or an agreement to it may allow the employee to perform their labor functions remotely permanently or temporarily (for a period of not more than six months); it is also possible to alternate distance work and work at a permanent workplace.
The document also defines:
- Temporary transfer of the employee to the distance mode without their consent. It relates to such situations as disasters and accidents, industrial accidents, fires, floods, earthquakes, epidemics, and any exceptional cases that endanger the life or normal living conditions of the entire population or part of it.
- Additional guarantees for the remuneration of remote workers. The transition to distance work cannot be the basis for a reduction in wages.
- When transferring to a "remote" job, the employer is provided with the necessary equipment; when using their equipment, the expenses are compensated in the manner and amount approved by the local act.
- Payment for business trips to distance workers.
- Grounds for dismissing employees (in particular, they cannot be fired for absenteeism). The contract with a distant worker is terminated if they do not contact the employer for more than two working days without a valid reason.
