State Duma will oblige to register house as property immediately after construction

The State Duma adopted a bill in the first reading at a plenary session. The bill proposes to introduce an obligation for citizens to register rights to buildings or structures erected on land plots immediately after construction is completed.

The Russian government introduced this bill to the chamber of parliament in May. The document provides for changes to several federal laws, including the Urban Development and Land Codes of the Russian Federation. The explanatory note states that in the territory of each subject of the country, there are from 1 to 5 thousand individual completed residential buildings used by citizens but not registered in the cadastral register, and the rights to them are not registered. According to the initiative's authors, this situation does not allow for proper statistical accounting of the housing stock. It creates lost revenue for local budgets because houses are not subject to taxation until they register rights to them. The bill proposes introducing the obligation to register buildings, structures, or their reconstruction on land plots with the cadastral register and register the rights. The explanatory note specifies that persons who fail to fulfill such an obligation will bear administrative liability for failure to comply with the procedure for state registration of rights to constructed buildings and structures (premises or parking spaces in them).
