Anatoly Aksakov: the bank system needs the mechanism of prejudicial adjustment of disputes

The bank system urgently needs the mechanism of prejudicial adjustment of disputes the President of Russian Regional Banks Association Anatoly Aksakov is certain. He shared his opinion in this respect with the participants of the First interregional scientific-practical conference “Financial-legal conflicts”, held in the National Bank RB today.

This necessity has become especially evident in connection with the financial crisis. At the end of 2008 the number of suits increased by 25% and at the beginning of 2009 it grew up two times more.

The practice shows that 7% of all disputes can be successfully solved before the court but at the same time the exact system of prejudicial conciliatory procedures is still absent in the country. The bill about mediation is found under consideration of State Duma now and it is called to fill this gap up.

This mechanism is well-known and successfully applied for a long time in the West. For example, the ombudsman – the authoritative and highly experienced lawyer – helps to regulate the conflicts amicably in Germany and his decision is considered unconditional, as a rule, and disputes come to the court only in exceptional cases.

In order to make the judicial procedures in Russia less complicated the Russian Regional Banks Association is ready to make a new link in its structure – the mediation center.
